it is in the context of bankruptcy proceedings that are deemed fraudulent/negligent by one of the parties and are asking the court to classify the bankruptcy proceedings as "culpable". i understand that "culpable" as either fraudulent or negligent.

AmE culpable insolvency<> BrE wrongful trading

Good idea to clarify the target jurisdiction as we may find that fraudulent bankruptcy may draw a blank in England & Wales and that bankruptcy does not exist in Scotland where it called sequestration.

It may be either fraudulent or wrongful / I put my money on the latter./

Hi Tom. Thanks for your answer. I think it is more negligent or wrongful than culpable. No target jurisdiction just have to explain the Spanish jurisdiction in English for non native Spanish speakers of English who are not English either.

culpable insolvency

This is the term used by the EU in English for Spanish "concurso culpable".

The classification is based on the reasons for the insolvency. It may be classified as fortuitous or culpable. An insolvency is fortuitous when it is not culpable. It is classified as culpable if it was brought about or aggravated by wilful misconduct or serious negligence on the part of the debtor and, in the case of legal persons, on the part of the debtor’s de facto and de jure directors or administrators.
