La tercera de las vías consistiría en acudir a los vicios ocultos, es decir, lo entregado adolecía de una serie de defectos importantes. Resulta un esfuerzo estéril el reflexionar sobre este supuesto porque la legislación mercantil establece una serie de plazos muy cortos para el ejercicio de la mencionada reclamación que permiten que descartemos de plano la posibilidad de ejercitar la misma porque el transcurso del tiempo veda esa alternativa, dado que se han superado los plazos que la ley determina para ello.
