Non, le domaine public est inaliénable et ne peut être grevé d’une servitude de droit privé. Même si votre parcelle est enclavée, vous n’obtiendrez pas de droit de passage sur un terrain public.
Peut-on refuser la pose de canalisations sur un terrain grevé d’une servitude de passage ?
Non, le droit de passage s’applique également au sous-sol. La pose de canalisations (eau, électricité, gaz, téléphone, câble …) ne peut être refusée.
