Should the Performance Test not be successful and if such failure is attributable to SELLER, the SELLER shall, within a Make Good Period of no more than three (3) months or more being agreed with the BUYER as from the first unsuccessful Performance Test, propose and execute all modifications and repairs and/or replacements of defective parts as are necessary to put the Equipment in proper working order to achieve the guaranteed performances (such proposition and execution of modifications, repairs and/or replacement being hereafter referred to as the “Make Good”).
