Marcilio Moreira states in his "Dicionário de Direito, Economia e Contabilidade: caução. security; bond; undertaking. Caução é sinônimo de GARANTIA (1). O termo undertaking é utilizado principalmente para cauções depositadas em juízo, por exemplo em garantia de uma medida liminar (temporary injunction).

(BrE) Security or suretyship is not required
(Deed of) suretyship is about the only alternative translation not included in past KudoZ answers.
Security without any article IMO works better than plain bond, unless prefaced 'no bond'.
In AmE, bail bond doubles as *criminal* bail and is also specifically used in marine cargo-insurance for BrE shipping. NB general security vs. security (bond in AmE) for legal and court costs in the UK & Ireland.
My suggested rewording of:
Art. 731 - Não são obrigados à caução:
I - O doador, que se reservar o usofruto da coisa doada.
II - Os pais, usofrutuários dos bens dos filhos menores.
Section/s. 731. No security is required of:
I. The donor (e.g. the settlor of a trust) who reserves unto him- or herself / retains / the beneficial ownership of (vs. a life interest in) the thing given cf. in UK revenue law, retaining a disastrously taxable interest in possession
II. Parents as the beneficiaries (vs. life tenants) of the assets of (their own - or adopted and fostered ?) under-age children.
