Discussion

Lara Barnett (asker) Jan 30, 2019:
@ Nikki Thanks. I understood the meaning and the sense of "prevent", I was just wondering if there was a specific legal phrase formulation that is commonly used here.
Nikki Scott-Despaigne Jan 29, 2019:
Meaning Ordinary dictionary meaning sets you on track here. https://www.larousse.fr/dictionnaires/francais/échec/27446/l...
"Faire échec à: empêcher quelqu'un, une action de réussir."
Thus, your meaning is "to prevent someone from succeeding in doing something, or to prevent something from happening, or coming about.

Web search To those who do not understand why I have posted an issue that can be found on the web, the reason I did this was due to the diversity of results I found, which confused me as regards this particular context.
Although I agree it must be great for you if you do not find conflicting results, when they sometimes appear on web searches, to be confusing.

French term (edited): faire échec à
Selected

to prevent (somone/something from - ING)

Try swtiching the word order round and/or using verbs instead of nouns.

"Aucune stipulation du contrat et autre ne peuvent faire échec au droit au renouvellement en vertu de l’article 123 alinéa 2 du traité OHADA relatif au Droit Commercial Général".

"Nothing that is stipulated in the contract, nor (any) other (contractual) provision, may prevent ..."

"Under the provisions of article 123 etc., ..."

These can be improved upon, but it should help get you started.

Prevent - Yes thanks. I did find "prevent" but I was not sure how correct this translation would have been in English.

may waive the right to

If you want legalese, this is a common way it can be said in US leases.

"Aucune stipulation du contrat et autre ne peuvent faire échec au droit au renouvellement en vertu de l’article 123" = "No contractual or other stipulation may waive the right to renewal set forth in article 123..."

the fact that it's African French plays a role in the translation
neutral Nikki Scott-Despaigne : Good for meaning, although the suggested translation needs tweaking.

This is only a reference. It's the translation in their own English version, not mine. Just thought it might jump-start the thought process
agree AllegroTrans : Ah yes, the thought process, parallel thinking, what a good idea
