Estoy traduciendo un documento chileno llamado "certificado de ejecutoria" al inglés para Australia. Básicamente es un documento que certifica que una sentencia dictada por el tribunal fue ejecutoriada/ejercida.
El certificado es muy corto pero no encuentro ningún documento parecido en inglés. Lo dejo a continuación:
"CERTIFICADO DE EJECUTORIA
CERTIFICO: que consultado el Sistema Informático de tramitación de causas del
Tribunal de Familia de [ciudad], SITFA, consta que la sentencia de fecha [fecha de sentencia], en causa [nº de causa], se
encuentra ejecutoriada"

Con independencia de lo que verse la sentencia a lo que se refiere es a que se acredita que la sentencia es firme, inmediatamente ejecutoria y que ya no puede recurrirse
¡Hola Emiliano! Muchísimas gracias por tu contribución. Estuve leyendo la fuente que citas y me parece que se relaciona más con una sentencia monetaria. En este caso, la causa pertenece a los tribunales de familia: el cuidado personal de un niño queda a cargo de la madre exclusivamente posterior a un acuerdo entre ambas partes (los padres). ¿Crees que aplique en estos casos? |

Hi Seth! Thanks for your answer. The ruling is not related to a divorce but to a judgment where the parental authority of a child was granted to their mother only. I was considering the "certificate of final judgment" option until I read it was linked to divorce rulings so I discarded it. What do you think? |

'.. al inglés para Australia': Alas, Maria, there is no such thing in Australia as a 'Certificate of Final Enforcement', as our UK-trained lawyer/s (Solicitor/s) in Oz - after factoring in the time-zone difference - might still care to confirm. Otherwise, it may be risky using a tautology as enforcement must be final, unless there has been a stay of execution.

Hi Adrian! Thank you so much. Enforceable judgment seems appropriate as the ruling implies the parental authority of a child was granted to their mother only. The judgment is final, conclusive and non-appealable, and this certificate is just saying that the judgment was enforced. |
