Повишаване капацитета на Комисията за борба с корупцията за противодействие на корупцията в публичната администрация и съдебната система
Дипломатическа нота

Тази задача включва като цяло подготовката на стратегически средства за реализацията на антикорупционен одит и на план за действие свързан с осъществяването на антикорупционен одит в Министерството на здравеопазването (МоЗ) и Министерството на образованието и науката (МОН).
Подготовката на средствата е сложен процес и изисква наличието на план за действие, който да бъде одобрен от основните заинтересовани лица. Създаването на средства е един интерактивен процес, който не може да бъде ясно разграничен от осъществяването на пилотните одити. Изработването на смислени средства за осъществяване на одит изисква добри познания за институционните структури, процесите и обстановката в тях, придобити чрез допитване до клиентите.
Според първоначалния доклад, планът за действие трябва да отговаря на следните въпроси:
• Къде ще бъдат извършвани антикорупционните одити?
• Кой ще ги извършва?
• Кога ще бъдат извършени?
• Какви ресурси са необходими затова? ( човешки, финансови и др. )
Част от процеса на одобрение от основния заинтересован участник включваше представяне на проектоплан, на семинар, в който участваха представители на високи постове в МоЗ и МОН, както и в съдебната система и КБК , състоял се на 26.04.2006г.
Подробно разгърнат, планът включва пет фази. Поради интерактивния характер на процеса, петте фази до голяма степен се препокриват. Тук ще направя кратко описание на фазите и обобщение на постигнатия до момента напредък. По-подробен график и описание на отговорностите може да намерите в приложението към този документ.
1. Идентифициране на най-застрашените от корупция места
Първата дейност в тази фаза представлява преглед на критичните длъжности, за които има вероятност да станат жертва на корупционни практики. От всички длъжности, разгледани подробно в „Структурната наредба на Министерството на здравеопазването”(2006) екипът от консултанти идентифицира онези, които могат да бъдат особено податливи на корупционни практики. За идентифицирането на тези длъжности са необходими известни познания за местната ситуация. Това бе постигнато с помощта на местни експерти и чрез анализ на корупционните доклади и на докладите в пресата и др. както и на базата на сравнение, особено със Структурната наредба на Министерството на здравеопазването (МоЗ).

The assignment involves the preparation of strategic tools for implementation of anticorruption audits in general, and an action plan for conducting anticorruption audits in the Ministry of Health (MoH), and in the Ministry of Education and Science (MES).
The preparation of the tools is a complex process and requires the existence of an action plan, endorsed by the main stakeholders. Developing the tools is also an iterative process which can not be clearly separated from conducting the pilot audits. Developing meaningful audit tools requires a good knowledge institutional structures, processes and contexts, obtained in enquiries with the client.
In accordance with the Inception Report, the action plan needs to respond to the following questions:
• Where will the anti-corruption audits be carried out?
• Who will carry out the anti-corruption audits?
• When will the anti-corruption audits be carried out?
• What are the needed resources (Human, financial, etc)?
As part of the endorsement of the process by the main stakeholder, a draft action plan was presented at a workshop carried out with high-level representatives from the MoH and MES, as well as from the judiciary and the CPCC on 26.04.2006.
In detail, the plan involves five phases. Given the iterative nature of the process, the five phases largely overlap. There follows a brief description of the phases, and a summary of progress to date. A more detailed timetable and description of responsibilities can be found in the annex to this document.
1. Identification of Corruption Hotspots
The first activity in this phase is to review critical functions, which are likely to be exposed to corrupt practices. From all functions detailed in the “Structural Regulation of the Ministry of Health” (2006), the consulting team identified those that might be particularly sensitive to corrupt practices. In order to identify those functions, certain knowledge of the local situation is necessary. This has been provided by local experts, and through analysis of corruption reports, and reports in the press, etc. and comparison, in particular, with the structural regulation of the Ministry of Health (MoH).

1.1 Biography and autobiography
The word biography is of Greek origin and means “life” (bio) and “description” (graph), i.e. description of life. Traditionally, the concept has three meanings:
1) As a literary-historical genre. Example: The biography of Napoleon, Van Gogh, etc. From this viewpoint, the biography pursues three main tasks:
• It reproduces the events of life of a character (historical figure).
• It presents material of a personality which serves for moral and civil education.
• It defines the place and importance of the characters in the field of history (local, regional, national and world) and culture (in literature, philosophy, science, etc.). The idea about this type of biography is to involve all aspects and circumstances of the life of the historical figure.
2) As an official document, containing a “dull” description of a person’s professional career. It is required when applying for a job and is filed with the employee’s personal record.
3) As a history of life or a person’s path of life. It examines the role of the life experience in building the personality.
The autobiography is a description of one’s own life. It may pursue the following aims:
• A life story or a chronicle of the events from one’s own life.
• A confession – sharing one’s own life experience.
• A self-analysis of the events that have taken place throughout one’s own life.
One integral feature of the autobiography is its writing down.
For the present topic, it is important to interpret autobiography as a self-analysis. !
1.2 Self-analysis for developing one’s personality
Biography work means first of all an analysis of the course of life lived. This analysis outlines those events of life, which have influenced directly the development of the personality. Self-analysis as an autobiography is in fact going back to the past. This retrospect has the task to make each person distinguish the important events in his/her life that have been involved in shaping his/her personality.
The core of the personality, the centre of our inner world, is occupied by the “I-concept”. The periphery of the inner world is formed and expanded by:
• All contacts of the individual with other people;
• The results of these interactions;
• The objective circumstances, which set as a precondition the short-term and long-term life goals.
The work on one’s own biography involves the following aspects:
• Individual aspects – temperament, character, intellectual development.
• Social and cultural aspects – parents, brothers, sisters, other important people outside of the family circle.
• Living experience – interpersonal perception and interaction with other people.
Very often, instead of using the terms biography and autobiography, we use “path of life” or “personal history”. Path of life means looking back into the past, mainly from the point of view of the succession of the events. Personal history focuses on the individual intimate part of the biography. The personal history is not only perceived as a combination of facts and events, but as a depository of the individual’s intellectual, social and emotional experience. It covers the space of one’s self-appraisal and self-identification and is an important source of identifying the needs, motives, and objectives of action, i.e. realising and verbalising the personal life plans.
The self-analysis of one’s own path of life or the personal history is an indispensable condition for developing one’s personality. !
Such a self-analysis does not happen as a daily review of activities. Rather such a referral to past events experienced takes place in:
• Moments of making important decisions
• Moments of crucial change in the individual’s life
• Extreme situations
• The context of guided biography work of children and young people growing up in extra-familial care
On a mental level, the important information from the biographic events is internalised in the system of needs and interests, values and standards. An important argument about the consistency/adequacy or inconsistency/inadequacy of this system is precisely the personal experience. In other words, when a person finds it difficult to make a decision about a specific behaviour, he/she updates in the memory such an event from his/her personal history that supports his/her proper choice: “In the past I acted this way in a similar situation and I always proved right.”
The biography, of course, is only one of the elements of the “I-concept”. In fact, its realisation determines the individual’s behaviour. By a self-analysis of one’s path of life or personal history:
• One shapes and confirms the cognitive convictions, moral standards, values, needs, interests, motives, dispositions and self-consciousness;
• One develops mechanisms for objective self-appraisal and self-identification by analysing one’s own feelings, emotions and tested life experience.
This places an emphasis on a characteristic of the biography. Biography is not a chaotic reflection, or a collection of quotations, but an organised knowledge structured by:
• The cognitive component of the consciousness, i.e. the cognitive activity of the individual.
• The sphere of need and motivation, i.e. the individual’s acts and deeds.
• The sphere of assessment and emotions, expressed in seeking a personal sense of life in the experienced events.

Думата “биография” е от гръцки произход и означава “живот” (bio) и “описание” (graph), т.е. животоописание. По принцип понятието има три значения :
1) Като литературно-исторически жанр. Например, биография на Наполеон, на Ван Гог и т. н. Разглеждана в тази светлина, биографията има три основни функции:
• Възпроизвежда събития от живота на своя герой (историческа фигура).
• Предоставя материал за личността му, който служи за нравствено и гражданско възпитание.
• Определя мястото и значението на своя герой за историята (местна, регионална, национална и световна) и културата (литературата, философията, науката и т. н.) Идеята на този тип биография е да обхване всички аспекти и обстоятелства около живота на историческата фигура.
2) Като официален документ под формата на “сухо” описание на собствената професионална кариера, който е необходим при кандинатстване за работа и се съхранява заедно с личното досие на служителя.
3) Като история за живота или жизнения път на човека. Тук се разглежда ролята на житейския опит при формирането на личността.
Автобиографията е описание на човешкия живот. Тя има за цел следното:
• Да представи историята на нечий живот или хроника за събитията, които са се случили през него.
• Изповед – човек споделя своя жизнен опит.
• Самоанализ на събитията, които съпътстват живота на човека.
Съществена характеристика на автобиографията е нейното написване.
Във връзка с настоящата тема е важно да разглеждаме автобиографията като самоанализ. !
1.2 Самоанализът като път към развитието на личността
Работата по изграждането на биографията означава най-вече анализ на жизнения път. В рамките на този анализ се открояват онези събития от живота, които са оказали пряко въздействие върху развитието на личността. Самоанализът, като форма на автобиографията представлява всъщност връщане към миналото. Задачата на тази ретроспекция е да накара всеки човек да разграничи тези съществени събития от живота си, дали отражение върху формирането на личността му.
Ядрото на личността, центърът на нашия вътрешен свят е зает от “представата за Азът”. Пефиферията на вътрешният ни свят се формира и доразширява от:
• Съвкупността от всички контакти на индивида с другите хора;
• Последиците от тези контакти;
• Обективните обстоятелства, които предопределят краткосрочните и дългорочните ни цели.
Работата по формирането на личната биография обхваща следните аспекти:
• Индивидуални аспекти – темперамента, характера, интелектуалното развитие.
• Социо-културни аспекти - родители, братя, сестри, други значими хора извън кръга на семейството.
• Житейски опит – начина, по който възприемаме и общуваме с останалите хора.
В много случаи, вместо да използваме термините “биография” и “автобиография”, използваме изразът “житейски път” или “лична история”. Житейският път е поглед към миналото от гледна точка на последователността от събития. Личната история поставя в центъра на вниманието по-личната част от биографията на индивида. Личната история се възприема не само като съчетание от факти и събития, но и като “хранилище” на интелектуалните, социални и емоционални преживявания на индивида. В нейният обсег попадат самооценката и самопознанието и тя е важен източник при идентификацията на потребностите, мотивите и целите на действие, т.е. при осъзнаването и вербализирането на личния план за живота.
Самоанализът на личния житейски път или личната история е задължително условие за развитието на личността. !
Такъв самоанализ не се прави всеки ден. Връщането към преживени минали събития става:
• В моменти, при които трябва да се вземат важни решения
• В моменти на поврат в живота
• При екстремни ситуации
• В контекста на подпомагане на деца и младежи от социални домове при изграждането на личната им биография
На психично равнище, съществената информация от биографичните събития се интернализира в системата от потребности и интереси, ценности и норми. Важно доказателство за последователността/адекватността или противоречивостта/неадекватността на тази система е именно личният опит. С други думи, когато на човек му е трудно да реши дали да постъпи по определен начин,той/тя си припомня подобно събитие от личната си история, което ще му помогне да направи правилиня избор: “В миналото съм постъпвал така в подобна ситуация и съм бил винаги прав.”
Естествено, биографията е само един от елементите на “Представата за Азът”. Всъщност, нейното осъзнаване определя поведението на личността. Чрез самоанализа на житейския си път или личната си история:
• Човек формира и затвърждава своите когнитивни убеждения, морални норми и ценности, потребности, интереси и подбуди, влеченията и самосъзнанието си;
• Развива механизми за обективна самооценка и самопознание чрез анализ на чувствата, емоциите и доказания житейски опит.
Тук се налага да наблегна на характеристиката на биографията. Биографията не е хаотично отражение или съвкупност от цитати, а организирано познание, в структурата на което влизат:
• Когнитивния компонент на съзнанието, т.е. когнитивната дейност на индивида .
• Сферата на потребностите и мотивацията, т.е. личните дела и постъпки.
• Сферата на оценката и емоциите, която намира израз в търсенето на личен смисъл във вече преживяното.
